Indian court pauses regulator ban on "energy drink" label for PepsiCo, Monster and Reliance

The Delhi High Court temporarily halted the Food Safety and Standards Authority of India's order that barred high‑caffeine beverages from being called "energy drinks." The relief applies to PepsiCo, Monster Beverage and Reliance Industries and was granted on 6 October 2026. The court said the case will continue, but the companies can now sell existing inventory with the label.

The ruling lets the three firms keep selling current stock labeled as "energy drink," avoiding immediate write‑offs and preserving revenue in a fast‑growing market; the companies have said the ban caused financial losses and operational disruption.

  • 4The regulatory ban was issued by the Food Safety and Standards Authority of India (FSSAI).
  • 5The Indian market for energy drinks is expected to be worth $1.6 billion by 2028.
