Pennsylvania sues insulin makers and PBMs for alleged price‑fixing scheme

The Pennsylvania Attorney General filed a lawsuit against 17 pharmaceutical companies and pharmacy‑benefit managers, including Eli Lilly, Sanofi, Novo Nordisk, CVS Caremark and OptumRx. The complaint alleges the defendants colluded to raise insulin prices by more than 1,000% since the mid‑2000s, harming about 1.3 million diabetics in the state. The state seeks restitution for patients, injunctive relief and civil penalties under its consumer‑protection law.

If the court rules for Pennsylvania, the companies could face civil penalties of $1,000 per violation and $3,000 per violation involving seniors, plus restitution payments, which may affect earnings and cash flow. The lawsuit also raises reputational risk and could prompt further regulatory scrutiny of insulin pricing.
