GSK and Moderna settle patent dispute over COVID‑19 and RSV vaccine technology

British drugmaker GSK and U.S. vaccine developer Moderna ended their litigation in the United States and Europe by signing a cross‑licensing agreement. The settlement, finalized on October 28, covers Moderna’s COVID‑19 shots Spikevax and mNEXSPIKE and its RSV vaccine mResvia, and requires no monetary payments from either side. Both firms asked a Delaware federal court to permanently dismiss GSK’s U.S. patent claims, removing the dispute from the courts.

GSK said the resolution removes legal uncertainty and lets both companies concentrate on advancing vaccine innovation. The removal of the lawsuit also eliminates future legal costs and potential damages for the parties.
