PepsiCo warns Indian court that energy‑drink label ban could cause nationwide stockouts

PepsiCo told the Delhi High Court that the Food Safety and Standards Authority of India's ban on the term “energy drink” could deplete its Indian supplies within two months. The company’s lawyer, Sandeep Sethi, said competitors such as Red Bull are still allowed to sell, while PepsiCo, Monster and Reliance Consumer are limited to existing stock. The court has not ruled on the merits and the next hearing is set for October 30.

If the ban remains, PepsiCo could lose sales in India’s fast‑growing energy‑drink market and face distribution disruptions, which may pressure its revenue from the region.

  • 1India’s Food Safety and Standards Authority (FSSAI) ordered makers of high‑caffeine drinks to stop using the term “energy drink” in June.
  • 2The Delhi High Court again refused to let PepsiCo resume making drinks with the “energy drink” label.
  • 3PepsiCo lawyer Sandeep Sethi warned the court that supplies would run out within two months.
  • 4Red Bull has secured a court reprieve and can continue manufacturing, while PepsiCo, Monster and Reliance Consumer are restricted to existing stock.
  • 5The next hearing in the case is scheduled for October 30.
