Wisconsin DNR formally alleges environmental violations by Enbridge

The Wisconsin Department of Natural Resources issued Enbridge Energy a formal notice on October 13 over alleged environmental-law and permit violations tied to the Line 5 reroute and a temporary bypass at the Saxon spill site. The notice identifies seven alleged violations involving water, wetlands, navigable waterways, air quality, stormwater and endangered resources. An enforcement conference is scheduled for October 26, after which the DNR could pursue citations or refer the matter for prosecution.

The notice begins a regulatory enforcement process for Enbridge but does not establish final penalties. The company could face fines of up to $10,000 per day for certain civil violations and up to $25,000 for each air-pollution violation, while the DNR continues its investigation.
